Injured by a Defective Product? What You Need to Know
5 min read
Companies must sell safe products. When they don't, injured consumers have the right to hold them accountable.
Three Types of Product Defects
Product liability claims generally fall into three categories: design defects (the product is inherently dangerous by design), manufacturing defects (a flaw occurred during production), and failure to warn (inadequate instructions or safety warnings).
Who Is Liable?
Depending on the case, liability can extend to designers, manufacturers, distributors, and retailers. You do not always need to prove negligence — California applies "strict liability" for defective products, meaning the product's defect itself can be enough.
Preserve the Product and Evidence
Keep the product, packaging, receipts, manuals, and any correspondence. Photograph your injuries and the scene where the injury occurred. Do not repair, discard, or return the product — it is critical evidence.
Compensation for Product Injuries
Injured consumers may recover medical expenses, lost wages, pain and suffering, and in some cases punitive damages when a company's conduct was especially reckless.
