Slip and Fall Accidents: Who Is Liable?
5 min read
Property owners must keep their premises safe. When they don't, injured visitors have the right to seek compensation.
Duty of Care
Property owners and occupiers in California have a legal duty to maintain reasonably safe premises and to warn visitors of hazards they know about — or should know about. This applies to stores, restaurants, apartment buildings, sidewalks, and private homes.
Proving Negligence
To win a slip and fall claim, you generally must show that a dangerous condition existed, the owner knew or should have known about it, and they failed to fix it or warn you. A wet floor with no sign, a broken handrail, or poor lighting can all support a claim.
Comparative Fault in California
California follows "pure comparative fault." If you were partly responsible — for example, by not watching where you walked — your compensation is reduced by your share of fault, but you can still recover.
Document the Hazard
Photograph the hazard immediately if you can, note the exact location and time, collect witness contact information, and save the clothes and shoes you wore. Report the incident to the property owner or manager and request a written report.
